An aspect of Peirce’s thought that may still be underappreciated is his resistance to what Levi calls _pedigree epistemology_, to the idea that a central focus in epistemology should be the justification of current beliefs. Somewhat more widely appreciated is his rejection of the subjective view of probability. We argue that Peirce’s criticisms of subjectivism, to the extent they grant such a conception of probability is viable at all, revert back to pedigree epistemology. A thoroughgoing rejection of pedigree in the (...) context of probabilistic epistemology, however, _does_ challenge prominent subjectivist responses to the problem of the priors. (shrink)

Emotion processing is known to be impaired in psychopathy, but less is known about the cognitive mechanisms that drive this. Our study examined experiencing and suppression of emotion processing in psychopathy. Participants, violent offenders with varying levels of psychopathy, viewed positive and negative images under conditions of passive viewing, experiencing and suppressing. Higher scoring psychopathics were more cardiovascularly responsive when processing negative information than positive, possibly reflecting an anomalously rewarding aspect of processing normally unpleasant material. When required to experience emotional (...) response, by ‘getting into the feeling’ of the emotion conveyed by a negative image, higher factor 1 psychopathic individuals showed reduced responsiveness, suggesting that they were less able to do this. These data, together with the absence of corresponding differences in subjective self-report might be used to inform clinical strategies for normalising emotion processing in psychopathic offenders to improve treatment outcome, and reduce risk amongst this client group. Lawrence Kohlberg's Approach to Moral Education presents what the late Lawrence Kohlberg regarded as the definitive statement of his educational theory. Addressing the sociology and social psychology of schooling, the authors propose that school culture become the center of moral education and research. They discuss how schools can develop as just and cohesive communities by involving students in democracy, and they focus on the moral decisions teachers and students face as they democratically resolve problems. This paper introduces a conceptual framework, denoted as ‘Line Theory,’ which is predicated on the procedural anatomy inherent in ordinary plans. A plan, recognized as a set of instructions for execution, undergoes in-depth scrutiny to analyze its constituent elements. The concise examination delves into the formation of line and effect within real space stemming from procedures. Line theory serves the purpose of elucidating the absolute optimization of plans. It is formulated to inaugurate an exploration into the veracity of procedures and (...) their elemental changes, examining their correlation with space and motion at the most fundamental level. The scientific community has extensively delved into the examination of the behavior and structure of objects at the microscopic level. This paper endeavors to stimulate interest in the analogous analysis of procedures. This paper explains how to use a new software tool for argument diagramming available free on the Internet, showing especially how it can be used in the classroom to enhance critical thinking in philosophy. The user loads a text file containing an argument into a box on the computer interface, and then creates an argument diagram by dragging lines from one node to another. A key feature is the support for argumentation schemes, common patterns of defeasible reasoning historically know as (...) topics . Several examples are presented, as well as the results of an experiment in using the system with students in a university classroom. (shrink)

Robert Kimball, in “What’s Wrong with Argumentum Ad Baculum?” (Argumentation, 2006) argues that dialogue-based models of rational argumentation do not satisfactorily account for what is objectionable about more malicious uses of threats encountered in some ad baculum arguments. We review the dialogue-based approach to argumentum ad baculum, and show how it can offer more than Kimball thinks for analyzing such threat arguments and ad baculum fallacies.

Ontologies are being used by information scientists in order to facilitate the sharing of meaningful information. However, computational ontologies are problematic in that they often decontextualize information. The semantic content of information is dependent upon the context in which it exists and the experience through which it emerges. For true semantic interoperability to occur among diverse information systems, within or across domains, information must remain contextualized. In order to bring more context to computational ontologies, we introduce culture as an essential (...) concept for information science. Culture helps to focus our attention on and make meaning of relevant extrapersonal structures and their qualities and dimensions that comprise the context and background of the world. In our approach, culture is integral to the study of semantics and, consequently, the study of ontologies and information technologies. The meaning we make of entities and phenomena in the world is always shaped by our cultural experience. If we understand culture as the emergent interplay of intrapersonal cognitive structures and extrapersonal structures of the world, then the notion of cognitive and cultural schemas becomes essential to understanding ontology and the ways in which we might achieve authentic semantic interoperability among diverse information systems. We explore the nature of ontologies and reconceptualize them as cultural schemas. Our proposal is an alternative to the historical path from philosophical ontology to computational ontologies as one that adheres primarily to the notion of ontology as a categorization and classification system. The obvious implication for ontology as categorization is that there is a single objective world that exists and that it can be described as entirely separate from the person observing it. We draw upon Heidegger’s examination of ontology to ground ontology in a phenomenological perspective, enabling it to remain flexible and adaptable and to accommodate context. (shrink)

The electric activities of cortical pyramidal neurons are supported by structurally stable, morphologically complex axo-dendritic trees. Anatomical differences between axons and dendrites in regard to their length or caliber reflect the underlying functional specializations, for input or output of neural information, respectively. For a proper assessment of the computational capacity of pyramidal neurons, we have analyzed an extensive dataset of three-dimensional digital reconstructions from the NeuroMorphoOrg database, and quantified basic dendritic or axonal morphometric measures in different regions and layers of (...) the mouse, rat or human cerebral cortex. Physical estimates of the total number and type of ions involved in neuronal electric spiking based on the obtained morphometric data, combined with energetics of neurotransmitter release and signaling fueled by glucose consumed by the active brain, support highly efficient cerebral computation performed at the thermodynamically allowed Landauer limit for implementation of irreversible logical operations. Individual proton tunneling events in voltage-sensing S4 protein alpha-helices of Na+, K+ or Ca2+ ion channels are ideally suited to serve as single Landauer elementary logical operations that are then amplified by selective ionic currents traversing the open channel pores. This miniaturization of computational gating allows the execution of over 1.2 zetta logical operations per second in the human cerebral cortex without combusting the brain by the released heat. A newborn baby is an infant within the first 28 days of birth. Diagnosis and treatment of infant diseases require specialized medical resources and expert knowledge. However, there is a shortage of such professionals globally, particularly in low-income countries. To address this challenge, a knowledge-based system was designed to aid in the diagnosis and treatment of neonatal diseases. The system utilizes both machine learning and health expert knowledge, and a hybrid data mining process model was used to extract knowledge from (...) a clinical dataset. The PART algorithm achieved the highest performance result with 98.06% accuracy under 10-fold cross-validation, and the generated rules were used to develop the knowledge-based system. The system achieved 90.9% accuracy in system performance testing and 89.2% in user acceptance testing, and is intended to serve as an assistant tool for healthcare experts. (shrink)

Biological order provided by α-helical secondary protein structures is an important resource exploitable by living organisms for increasing the efficiency of energy transport. In particular, self-trapping of amide I energy quanta by the induced phonon deformation of the hydrogen-bonded lattice of peptide groups is capable of generating either pinned or moving solitary waves following the Davydov quasiparticle/soliton model. The effect of applied in-phase Gaussian pulses of amide I energy, however, was found to be strongly dependent on the site of application. (...) Moving solitons were only launched when the amide I energy was applied at one of the α-helix ends, whereas pinned solitons were produced in the α-helix interior. In this paper, we describe a general mechanism that launches moving solitons in the interior of the α-helix through phase-modulated Gaussian pulses of amide I energy. We also compare the predicted soliton velocity based on effective soliton mass and the observed soliton velocity in computer simulations for different parameter values of the isotropy of the exciton-phonon interaction. The presented results demonstrate the capacity for explicit control of soliton velocity in protein α-helices, and further support the plausibility of gradual optimization of quantum dynamics for achieving specialized protein functions through natural selection. The essential biological processes that sustain life are catalyzed by protein nano-engines, which maintain living systems in far-from-equilibrium ordered states. To investigate energetic processes in proteins, we have analyzed the system of generalized Davydov equations that govern the quantum dynamics of multiple amide I exciton quanta propagating along the hydrogen-bonded peptide groups in α-helices. Computational simulations have confirmed the generation of moving Davydov solitons by applied pulses of amide I energy for protein α-helices of varying length. The stability and mobility (...) of these solitons depended on the uniformity of dipole-dipole coupling between amide I oscillators, and the isotropy of the exciton-phonon interaction. Davydov solitons were also able to quantum tunnel through massive barriers, or to quantum interfere at collision sites. The results presented here support a nontrivial role of quantum effects in biological systems that lies beyond the mechanistic support of covalent bonds as binding agents of macromolecular structures. Quantum tunneling and interference of Davydov solitons provide catalytically active macromolecular protein complexes with a physical mechanism allowing highly efficient transport, delivery, and utilization of free energy, besides the evolutionary mandate of biological order that supports the existence of such genuine quantum phenomena, and may indeed demarcate the quantum boundaries of life. Protein α-helices provide an ordered biological environment that is conducive to soliton-assisted energy transport. The nonlinear interaction between amide I excitons and phonon deformations induced in the hydrogen-bonded lattice of peptide groups leads to self-trapping of the amide I energy, thereby creating a localized quasiparticle (soliton) that persists at zero temperature. The presence of thermal noise, however, could destabilize the protein soliton and dissipate its energy within a finite lifetime. In this work, we have computationally solved the system of stochastic (...) differential equations that govern the quantum dynamics of protein solitons at physiological temperature, T=310 K, for either a single isolated α-helix spine of hydrogen bonded peptide groups or the full protein α-helix comprised of three parallel α-helix spines. The simulated stochastic dynamics revealed that although the thermal noise is detrimental for the single isolated α-helix spine, the cooperative action of three amide I exciton quanta in the full protein α-helix ensures soliton lifetime of over 30 ps, during which the amide I energy could be transported along the entire extent of an 18-nm-long α-helix. Thus, macromolecular protein complexes, which are built up of protein α-helices could harness soliton-assisted energy transport at physiological temperature. Because the hydrolysis of a single adenosine triphosphate molecule is able to initiate three amide I exciton quanta, it is feasible that multiquantal protein solitons subserve a variety of specialized physiological functions in living systems. Macromolecular protein complexes catalyze essential physiological processes that sustain life. Various interactions between protein subunits could increase the effective mass of certain peptide groups, thereby compartmentalizing protein α-helices. Here, we study the differential effects of applied massive barriers upon the soliton-assisted energy transport within proteins. We demonstrate that excentric barriers, localized onto a single spine in the protein α-helix, reflect or trap three-spine solitons as effectively as concentric barriers with comparable total mass. Furthermore, wider protein solitons, whose energy is lower, (...) require heavier massive barriers for soliton reflection or trapping. Regulation of energy transport, delivery and utilization at protein active sites could thus be achieved through control of the soliton width, or of the effective mass of the protein subunits. This study emphasizes the importance of enhancing food safety and hygiene practices among sidewalk vendors to safeguard public health in Balayan Public Market. Employing a mixed-methods approach, with both quantitative and qualitative components, a diverse sample of 55 consumers, 5 sidewalk vendors, and 5 market administrators was selected using a combination of purposive and random sampling techniques under non-probability sampling. Microbial investigations were conducted during both the initial sampling and testing phase (A) and subsequent sampling and testing phase (B) on (...) popular street food items at Lipa Quality Control Inc., including chicken nuggets, chicken nugget sauce (sweet and vinegar), Isaw, Isaw sauce, Proben, Proben sauce, Calamares, Calamares Vinegar Sauce, Kwek- Kwek, and Kwek-Kwek sauce. The findings reveal that “Isaw and Chicken Nuggets Sauce (Sweet)” had a result of “Too Numerous To Count (TNTC),” indicating an extraordinarily high bacteria count. This underscores the imperative need to raise awareness and provide targeted guidance to sidewalk vendors regarding essential food handling, storage, and sanitation practices. Therefore, a sanitary action plan is developed to promote community engagement, educational initiatives, and regulatory support, enhancing food safety practices among sidewalk vendors and ensuring a safer and healthier food environment. In the beginning of the 20th century the groundbreaking work of Ramon y Cajal firmly established the neuron doctrine, according to which neurons are the basic structural and functional units of the nervous system. Von Weldeyer coined the term “neuron” in 1891, but the huge leap forward in neuroscience was due to Cajal’s meticulous microscopic observations of brain sections stained with an improved version of Golgi’s la reazione nera (black reaction). The latter improvement of Golgi’s technique made it possible to (...) visualize the arborizations of single neurons that were “colored brownish black even to their finest branchlets, standing out with unsurpassable clarity upon a transparent yellow background. All was sharp as a sketch with Chinese ink”. The high quality of both the visualization of individual nerve cells and the work performed on studying the anatomy of the central nervous system lead Ramon y Cajal to the conclusion that axons output the nervous impulses to the dendrites or the soma of other target neurons. Background If trials of therapeutic interventions are to serve society's interests, they must be of high methodological quality and must satisfy moral commitments to human subjects. The authors set out to develop a clinical - trials compendium in which standards for the ethical treatment of human subjects are integrated with standards for research methods. Methods The authors rank-ordered the world's nations and chose the 31 with >700 active trials as of 24 July 2008. Governmental and other authoritative entities of the (...) 31 countries were searched, and 1004 English-language documents containing ethical and/or methodological standards for clinical trials were identified. The authors extracted standards from 144 of those: 50 designated as ‘core’, 39 addressing trials of invasive procedures and a 5% sample of the remainder. As the integrating framework for the standards we developed a coherent taxonomy encompassing all elements of a trial's stages. Findings Review of the 144 documents yielded nearly 15 000 discrete standards. After duplicates were removed, 5903 substantive standards remained, distributed in the taxonomy as follows: initiation, 1401 standards, 8 divisions; design, 1869 standards, 16 divisions; conduct, 1473 standards, 8 divisions; analysing and reporting results, 997 standards, four divisions; and post-trial standards, 168 standards, 5 divisions. Conclusions The overwhelming number of source documents and standards uncovered in this study was not anticipated beforehand and confirms the extraordinary complexity of the clinical trials enterprise. This taxonomy of multinational ethical and methodological standards may help trialists and overseers improve the quality of clinical trials, particularly given the globalisation of clinical research. Next, we develop an algorithmic approach for computing the complement of the single valued neutrosophic graph. A numerical example is demonstrated for computing the complement of single valued neutrosophic graphs and uniform single valued neutrosophic graph.

Multidimensional adjectives are ubiquitous in natural language. An adjective F is multidimensional just in case whether F applies to an object or pair of objects depends on how those objects stand with respect to multiple underlying dimensions of F-ness. Developing a semantics for multidimensional adjectives requires us to address the problem of dimensional aggregation: how do the application conditions of an adjective F in its positive and comparative forms depend on its underlying dimensions? Here we develop a semantics for multidimensional (...) adjectives that incorporates aggregation functions. We then explore an analogy between dimensional aggregation and preference aggregation, bringing results from social choice theory to bear on the number and kind of aggregation functions that are admissible in a context. These results suggest that, for any given adjective, there will often be multiple aggregation functions admissible, meaning that multidimensional comparatives are often vague. (shrink)

Critical notice of Tom Sorell's Scientism: Philosophy and the Infatuation with Science.

Manifold expressions of a particular critique appear throughout Søren Kierkegaard’s pseudonymous corpus: for Kierkegaard and his pseudonyms faith is categorically not a first immediacy, and it is certainly not the first immediate, the annulment of which concludes the first movement of Hegelian philosophy. Kierkegaard’s pseudonyms make it clear that he holds the Hegelian dogmaticians responsible for the promulgation of this misconception, but when Kierkegaard’s journals and papers are consulted another transgressor emerges: the renowned anti-idealist F.D.E. Schleiermacher. I address the extent (...) to which this particular indictment is justified; over-against Gerhard Schreiber, I argue that this characterization of Schleiermacher’s view of religion is indeed a de facto critique. I begin by presenting and demonstrating the ubiquity of the phenomenon at the heart of Schleiermacher’s conception of perfect God-consciousness, then proceed to apply criticisms raised by Kierkegaardian pseudonyms Judge William, Vigilius Haufniensis, Johannes Climacus, and Anti-Climacus, supplemented with concerns raised by Kierkegaard himself, in order to demonstrate that these criticisms do indeed apply to and problematize Schleiermacher’s view. Self destruction, inapprehensible an option as it might be, has been a challenging issue for philosophers and scholars since the dawn of time, forcing meditation into a vigorous and everlasting debate. The core question is: could suicide ever be deemed rational a choice? And if so, could it count as a moral alternative, if the circumstances call for it? The Stoics from Zeno up to Epictetus and Seneca regarded suicide as the ultimate resort, as the utmost opportunity for a rational (...) being to maintain his virtue, when all other bridges are burnt. For an act to be moral, it has to be deliberate, as well as the manifestation of an established evaluative hierarchy, however spontaneous and instantaneous might the latter be. In other words, a moral act is one that agents rationally opt for over other possible alternatives, on the subjective basis of their alleged best interests. Modern philosophers as Tom Beauchamp, Margaret Battin and Jacques Choron stress the criterion of rationality as a key issue regarding the ethics of suicide. Utilizing Rorty’s second definition of rationality, the article examines whether self destruction can be the outcome of proper evaluative assessment and deliberation, given that, as T. N. Pelegrinis suggests, such an evaluation seems to rest on a symmetry case, which might hardly be based on sound foundation. (shrink)

In this paper, we provide a detailed review of previous classifications of 2 × 2 games and suggest a mathematically simple way to classify the symmetric 2 × 2 games based on a decomposition of the payoff matrix into a cooperative and a zero-sum part. We argue that differences in the interaction between the parts is what makes games interesting in different ways. Our claim is supported by evolutionary computer experiments and findings in previous literature. The U.S. doctrine of employment-at-will, modified legislatively for protected groups, is being less harshly applied to managerial personnel. Comparable compensation is not otherwise available in the U.S. to workers displaced by technology. Nine pairs of arguments are presented to show how fundamentally management and labor disagree about a company's responsibility for its former employees. These arguments, born of years of labor-management debate, are kaleidoscopic claims about which side has what power. This paper explored the frameworks of the learning continuity plan that shaped basic education delivery as issued by the Department of Education-Central Office in light of Sulong Edukalidad and KITE (K- K to 12 Curriculum review and update; I- Improvement of the learning environment, T- Teachers' upskilling and reskilling; and E- Engagement of stakeholders for support and collaboration) as national flagship programs. In particular, the paper examined the adoption and contextualization of the frameworks by the Regional Office - CALABARZON, which (...) is the PIVOT4A QuBE; 4A represents the four strategic thrusts, which are: (a) aligning focus and intervention, (b) advancing handholding initiatives, (c) amplifying defined technical assistance to target delivery units, and (d) appraising stakeholders on the progress of the intervention, and QuBE is the acronym for Quality Basic Education. For its part, the Schools Division Office of Laguna espouses LAGO Laguna or Leaders Actions towards Greater Outcomes. Furthermore, the school learning continuity plan of the San Pedro Relocation Center National High School Landayan Annex is summarized through the acronym SAGWAN or Sustaining & Advocating Genuine Welfare & Actions in the New Normal as the flagship program. In addressing the new normal in education, the juxtapositions of the said flagship programs that stem from national to regional, division, and school levels, are discussed. It also analyzed diversity and inclusiveness, as well as the guiding educational philosophies, in the conduct of school projects, programs, and activities (PPAs). (shrink)

How should one respond to scepticism? Should one seek to refute it? Or should scepticism be ignored? This paper argues that descriptive metaphysics occupies an intermediate logical space between truth-directed transcendental arguments aimed at refuting the sceptic and the quietist stance of the Humean naturalist who declines to take up the sceptical challenge. Descriptive metaphysics is neither quietist nor confrontational. It seeks to show, rather, that the sceptic is not a genuine partner in conversation.

The main objective o f this descriptive paper is to present the general notion of translation between logical systems as studied by the GTAL research group, as well as its main results, questions, problems and indagations. Logical systems here are defined in the most general sense, as sets endowed with consequence relations; translations between logical systems are characterized as maps which preserve consequence relations (that is, as continuous functions between those sets). In this sense, logics together with translations form a (...) bicomplete category of which topological spaces with topological continuous functions constitute a full subcategory. We also describe other uses of translations in providing new semantics for non-classical logics and in investigating duality between them. An important subclass of translations, the conservative translations, which strongly preserve consequence relations, is introduced and studied. Some specific new examples of translations involving modal logics, many-valued logics, para- consistent logics, intuitionistic and classical logics are also described. (shrink)

A number of cognitive and behavioral variables influence the performance in tasks of theory of mind (ToM). Since two of the most important variables, memory and explicit expression, are impaired in schizophrenic patients, the ToM appears inconsistent in these patients. An ideal instrument of ToM should therefore account for deficient memory and impaired ability of these patients to explicitly express intentions. If such an instrument is developed, it should provide information that can be used not only to understand the pathophysiology (...) but also to monitor patients. (shrink)

It surveys the diverse technologies and intellectual domains that have contributed to spatial imaging, and argues that it is an important example of an interdisciplinary subject. Over the past century-and-a-half, specialists from distinct fields have devised explanations and systems for the experience of 3-D imagery. Successive audiences have found these visual experiences compelling, adapting quickly to new technical possibilities and seeking new ones. These complementary (...) interests, and their distinct perspectives, have co-evolved in lock-step. A driver for this evolution is visual culture, which has grown to value and demand the spectacular. As a result, professional and popular engagements with 3-D have had periods of both popularity and indifference, and cultural consensus has proven to be ephemeral. (shrink)

One of the important questions discussed by philosophers of technology has to do with the moral significance of artefacts in human life. While many philosophers agree that artefacts do have moral significance attached to them, opinions vary as to how it is to be construed. In this paper we deal with the approach of the influential Dutch philosopher of technology Peter Paul Verbeek. He criticizes traditional ethical theories for assuming that whatever relevancy artefacts have for morality is entirely dependent on (...) human beings, since artefacts are mere passive instruments of human agency. In contrast, he develops a view of moral agency that includes artefacts and that ascribes moral agency to human-technology hybrids rather than to humans as such. The goal of this paper is to elucidate Verbeek’s account of moral agency and evaluate it. We also deal with his views on post phenomenology and mediation underlying this account. Although the general gist of our paper is expository, we point out to several problems for Verbeek’s account. (shrink)

El presente trabajo de tesis se centra en el estoicismo, en la obra titulada Disertaciones que recoge las enseñanzas de Epicteto pero que fue recopilada por Arriano. Es en tal texto en el que principalmente basamos la presente tesis. Analizamos las enseñanzas de Epicteto, filósofo nacido en Hierópolis (Frigia) hacia el 55 d.C., que fue un liberto que se adentró en el estoicismo tras asistir a las clases del filósofo Musonio Rufo; gracias al permiso de su amo Epafrodito pudo asistir (...) a las pláticas de tal erudito. Los dos temas a tratar, el poder y el amor, que forman parte de la ética y de la filosofía política –estoicas-, así como de la epistemología, la física y la metafísica, por ser el sistema estoico uno que está estrecha y racionalmente interconectado, han sido abordados por investigadores recientes desde distintos ámbitos y perspectivas. El poder y el amor son conceptos que deben de ser explicados y analizados a partir de los conceptos mencionados de “sentimiento”, “inclinación”, “pasión”, “bueno”, “malo”, además de los de “virtud”, “vicio”, “indiferente”, “oikéiosis”, “deber”, “sabio”, “libertad”, etc. Por lo que ambas categorías han sido abordadas desde su vinculación con, o a partir de su explicación a través de, uno o varios de los conceptos mencionados. The events of September 11, 2001, have challenged many disciplines and professions, but have they really engendered a philosophical challenge? The title of this book suggests they have, and if so one would expect its contribution to show how the violence perpetrated that day and in its aftermath has challenged philosophy. In fact, few of the otherwise interesting essays do this very clearly.

This study assessed external debts and the financing of education in Nigeria using time series data obtained from World Bank, and CBN Statistical Bulletin covering a period of 31 years from 1988 -2018. The model of the study was derived, while the data collected were analysed using the Ordinary Least Squares. Diagnostic tests such as Augmented Dickey- Fuller (ADF) unit root test, Johansen co-integration, Vector Error Correction (VEC) techniques of estimation, and Granger Causality tests were all performed. Findings revealed a (...) significant long-run relationship between external debts and the financing of education; external debts have a significant effect (F=39.07055, p<.05) on the financing of education in Nigeria; external debt stock and external debt service payment have no significant effect on the financing of education; real GDP and Exchange rate have a significant effect on the financing of education in Nigeria respectively. Based on these findings, it was concluded that external debt is a big hindrance to the financing of education and consequently, the economic growth of Nigeria. It was recommended amongst others that the government should use borrowed funds from external sources for productive capital projects or development initiatives such as investment in education and the eradication of illiteracy. D’un point de vue sociologique, l’architecture du droit global se caractérise par une prééminence des normes de « connectivité », qu’il convient de distinguer des normes de « possibilité » et des normes de « cohérence ». La centralité des normes de connectivité dans cette structure provient de la fonction même du droit global, qui vise à faciliter le transfert de composants sociaux condensés –_tels que le capital, les produits économiques, les doctrines religieuses ou les connaissances scientifiques_–, d’un environnement juridique (...) à un autre à l’échelle planétaire. Cela se vérifie aussi bien dans le cas du colonialisme et du droit colonial que dans celui, aujourd’hui, des chaînes de valeur globales et des droits de l’homme. Le droit colonial et le droit des droits humains peuvent tous deux être compris comme des moyens de remplir une même fonction constituante de stabilisation et de facilitation de la connectivité. Cette compréhension trouve un écho significatif dans le droit international privé, qui participe de la même fonction. (shrink)

Habituellement considéré comme un phénomène des années 1970, le débat entre Jürgen Habermas et Niklas Luhmann s’est en réalité poursuivi jusqu’à la mort de Luhmann, en 1998 ; et l’évolution des positions des deux théoriciens au cours des années 1980 et 1990 s’est caractérisée par une convergence, plutôt que par une divergence. Dans le domaine de la théorie du droit, suggère cet article, la convergence a progressé dans la mesure où la théorie de la discussion (Diskursetheorie) d’Habermas peut se caractériser (...) comme une superstructure normative au regard de la théorie descriptive de la société formulée par Luhmann. De plus, le résultat du débat a été une absorption presque complète de la théorie habermassienne par le complexe de la théorie des systèmes de Luhmann – issue facilitée par le fait que ce dernier a délibérément traduit les concepts habermassiens centraux dans les concepts de la théorie des systèmes. Le débat et la conversion d’Habermas ont été possibles parce que le travail de celui-ci mais aussi celui de Luhmann peuvent être considérés comme un fruit de la tradition idéaliste allemande. Luhmann n’a pas vu que cette manœuvre permettait la réalisation des objectifs normatifs d’Habermas ; pas plus qu’il n’a perçu qu’il pouvait éradiquer une faille centrale de la construction de la théorie des systèmes en permettant de cartographier le contexte dans lequel les distinctions sont tracées – problème d’importance cruciale pour saisir les relations entre les différents systèmes sociaux et les coordonner via le déploiement d’instruments juridiques. On this particular issue about ¨truth¨, I´d rather focus more on the specific problematization of ¨sentential truth¨. In other words, I will not be concerned with the truth of an event or an experience per se in the objective, intersubjective or subjective sense. In the present consideration, I´d be more concentrated on the truth of beliefs uttered in meaningful statements. This distinctively philosophical approach—in the linguistic-analytic tradition—is supportive of the intent to determine whether certain beliefs are matters of knowledge or (...) not with respect to how classical philosophy presupposes that ONLY true beliefs achieve the category of knowledge. In this sense, the question of being true or the problem of truth plays an intrinsic function in the technical aspect of philosophy mainly in the discipline of epistemology (the philosophical field that deals with the issue of knowledge). In the most fundamental formulation, knowledge is defined as true belief. To resolve whether a belief is true or not, it has to be initially articulated in a sensible statement and must finally pass the test of verification. (shrink)

The Report presents insights which illuminates the intertwinements of European regulatory policies and global governance arrangements. By pinning down the exact nature of the interaction between these two levels, the EU’s dilemma becomes obvious: On the one hand, stronger global governance can be a chance, through which the EU can clarify its own raison d’être of increased integration to the wider world. On the other hand, the design of the European project is being challenged by more assertive global structures. This (...) is especially the case in relation to the WTO regime, which is constraining the decisional autonomy of the EU, regarding the appropriateness of its content and its external effects. Thus, the regulation of services in the EU and the WTO are discussed in the first section of this report. Section two focuses on labour standards, which are analysed from different angles in order to clarify the functions of the WTO and the ILO, multinational companies as well as other private actors within this specific field. Standard linguistic analysis of syntax uses the T-model. This model requires the ordering: D-structure > S-structure > LF, where D-structure is the sentences deep structure, S-structure is its surface structure, and LF is its logical form. Between each of these representations there is movement which alters the order of the constituent words; movement is achieved using the principles and parameters of syntactic theory. Psychological analysis of sentence production is usually either serial or connectionist. Psychological serial models do not accommodate the (...) T-model immediately so that here a new model called the P-model is introduced. The P-model is different from previous linguistic and psychological models. Here it is argued that the LF representation should be replaced by a variant of Frege'sA three qualities (sense, reference, and force), called the FregeA representation or F-representation. In the F-representation the order of elements is not necessarily the same as that in LF and it is suggested that the correct ordering is: F-representation > D-structure > S-structure. This ordering appears to lead to a more natural view of sentence production and processing. Within this framework movement originates as the outcome of emphasis applied to the sentence. The requirement that the F-representation precedes the D-structure needs a picture of the particular principles and parameters which pertain to movement of words between representations. In general this would imply that there is a preferred or optimal ordering of the symbolic string in the F-representation. The standard ordering is retained because the general way of producing such an optimal ordering is unclear. In this case it is possible to produce an analysis of movement between LF and D-structure similar to the usual analysis of movement between S-structure and LF. The necessity of analyzing corrupted data suggests that a maximal amount of information about a language's grammar and lexicon is stored. (shrink)

Although epistasis is at the center of the Fisher-Wright debate, biologists not involved in the controversy are often unaware that there are actually two different formal definitions of epistasis. We compare concepts of genetic independence in the two theoretical traditions of evolutionary genetics, population genetics and quantitative genetics, and show how independence of gene action (represented by the multiplicative model of population genetics) can be different from the absence of gene interaction (represented by the linear additive model of quantitative genetics). (...) The two formulations converge with weak selection but not with strong selection or, for multiple loci, when the aggregated interaction terms are not negligible. As a result of the different formulations of gene interaction, the presence or absence of linkage disequilibrium,/D/, does not necessarily indicate the presence or absence of fitness epistasis. Indeed, linkage disequilibrium is generated in ‘additive’ models in quantitative genetics whenever two (or more) loci experience simultaneous selection. As a research strategy, it is often practical, for theoretical or experimental reasons, to minimize gene interaction by assuming independence of gene action in regard to fitness, or by assuming linear additive effects of multiple loci on a phenotype. However, minimizing the role of epistasis in theoretical investigations hinders our understanding of the origins of diversity and the evolution of complex phenotypes. (shrink)
